Acceptance of Terms
By accessing and using the Sacramento Diamond Foundation website (“the Site”) at sacdiamondfoundation.org, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Site.
The Sacramento Diamond Foundation (“SDF,” “the Foundation,” “we,” “our,” or “us”) operates as a recognized 501(c)(3) tax-exempt public charity (EIN: 93-3705904).
Use of the Site
Permitted Use
You may use the Site for lawful purposes related to learning about the Foundation, making donations, registering for events, applying for programs, and accessing member-only content if you hold an authorized account. All use must be consistent with the Foundation’s mission of education, youth development, and community empowerment.
Prohibited Activities
When using the Site, you agree not to:
- Violate any applicable federal, state, or local laws or regulations
- Infringe upon the intellectual property rights of the Foundation or any third party
- Submit false, misleading, or fraudulent information
- Attempt to gain unauthorized access to restricted areas of the Site, including the member portal
- Use the Site to transmit malware, spam, or harmful code
- Engage in any activity that interferes with or disrupts the Site’s functionality
- Use automated means (scraping, bots) to collect data from the Site without express written permission
- Post or transmit content that is defamatory, obscene, harassing, or otherwise objectionable
Intellectual Property
All content on the Site — including text, graphics, logos, images, photographs, videos, and the Sacramento Diamond Foundation name and logo — is the property of the Sacramento Diamond Foundation or its content suppliers and is protected by United States and international copyright, trademark, and intellectual property laws.
You may view, download, and print pages from the Site for your personal, non-commercial use only. Any other use, including reproduction, modification, distribution, transmission, or republication of Site content without prior written permission from the Foundation is strictly prohibited.
The “Sacramento Diamond Foundation” name, the Foundation logo, and all related branding are trademarks of the Sacramento Diamond Foundation.
Donations and Transactions
Donation Processing
All donations made through the Site are processed through secure third-party payment processors. By making a donation, you represent that you are authorized to use the payment method provided and that all information you supply is true and accurate. The Sacramento Diamond Foundation is not responsible for errors made by payment processors.
Tax Deductibility
The Sacramento Diamond Foundation is a 501(c)(3) tax-exempt public charity. Donations are tax-deductible to the fullest extent allowed by law. Donors will receive an acknowledgment suitable for tax purposes. Donors are encouraged to consult with their tax advisors regarding the deductibility of their contributions.
Refund Policy
Donations made to the Sacramento Diamond Foundation are generally non-refundable. If you believe an error was made in your donation, please contact us within 30 days of the transaction at info@sacdiamondfoundation.org. Refund requests will be reviewed on a case-by-case basis.
Endowment Donations
Contributions designated for The AES Dr. Bernie Davito & Charles Carter Endowment Fund are governed by the terms of the Agreement to Endow and are restricted to supporting the Foundation’s long-term financial sustainability, programmatic impact, and core operational needs including staffing, technology, compliance, and infrastructure.
Member Portal
Access to the members-only area of the Site is restricted to authorized members of the Sacramento Diamond Foundation. Membership access is granted by invitation and subject to approval by Foundation administrators. Members are responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account. The Foundation reserves the right to suspend or terminate member access at any time for violation of these Terms or Foundation policies.
The member portal serves as a platform for sharing sensitive Foundation information among authorized members. Members agree to handle all information accessed through the portal in accordance with the Foundation’s Code of Ethics / Standards of Business Conduct and Standard of Performance Policy.
Third-Party Links and Services
The Site may contain links to third-party websites and services, including social media platforms, payment processors, event registration services, and partner organizations. These links are provided for convenience only. The Sacramento Diamond Foundation does not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party sites. You access third-party sites at your own risk.
Disclaimer of Warranties
The Site and its content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. The Sacramento Diamond Foundation does not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. To the fullest extent permitted by law, the Foundation disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
Limitation of Liability
To the fullest extent permitted by applicable law, the Sacramento Diamond Foundation, its officers, directors, employees, volunteers, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of or inability to use the Site, including but not limited to damages for loss of profits, data, or goodwill.
Indemnification
You agree to indemnify, defend, and hold harmless the Sacramento Diamond Foundation, its officers, directors, employees, volunteers, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Sacramento County, California.
Modifications to Terms
We reserve the right to modify these Terms and Conditions at any time, consistent with the Foundation’s governance principle that policies “will change from time to time as necessitated by prevailing changes in the business environment and governmental regulation.” Changes will be effective immediately upon posting to the Site. Your continued use of the Site after changes are posted constitutes acceptance of the modified Terms. We encourage you to review this page periodically.
Termination
The Sacramento Diamond Foundation reserves the right to terminate or suspend your access to the Site, without prior notice or liability, for any reason, including violation of these Terms and Conditions.
